This agreement shall be binding on you and any such related party. ERDP designates certain Software and Information as being available to you. You may use this Software and Information subject to the terms and conditions of the license set in this Agreement. You agree that you will use Software or Information only to the extent that you have been authorized by ERDP pursuant to this Agreement.

The Software and Information made available under this Agreement are licensed, not sold, to you by ELDP. ELDP reserves all rights not expressly granted.

All title and copyrights in and to the software, including but not limited to any images, texts, and sounds incorporated into the software, are owned by ELDP or its suppliers.

In addition to your right to use the Software and Information internally, you may make a single archival copy of Software and Information to the extent permitted by law. You shall not otherwise reproduce the Software or Information, or modify or distribute all or any portion of the Software or Information. You may not create derivative works from the Software and Information.

You may not rent, lease, lend or encumber Software or Information, or use the Software or Information in any manner to provide time-share or service bureau services.

The scope of your license does not include any right, express or implied,

1. to access, reproduce, distribute, display or use the Software or Information to provide diagnostic, maintenance, repair or technical support services on behalf of any third party for your direct or indirect commercial gain or advantage without ERDP’s prior written authorization, or
2. for any third party to access, reproduce, distribute, display or use the Software or Information to provide diagnostic, maintenance, repair or technical support services on your behalf for such party’s direct or indirect commercial gain or advantage, without ERDP ‘s prior written authorization.

You may not decompile, disassemble, or reverse-engineer Software except to the extent otherwise permitted by law.

No right, title or interest in or to any trademark, service mark, logo or trade name of ERDP is granted under this Agreement.

Disclaimer of warranty: The software and the accompanying files are provided “As is” without warranty of any kind. To the maximum extent permitted by applicable law, EMOTIONLESS Realtime DataPro (ERDP) (www.EMOTIONLESStrading.in) disclaims all warranties, expressed or implied, including, but not limited to, any implied warranties of performance, Merchantability fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law, in no event shall EMOTIONLESS Realtime DataPro (ERDP) be liable for any direct, indirect, consequential or incidental damages ( including, but not limited to, damages for loss of business profits, business interruption or loss of business information) arising out of the use of or inability to use the software, even if EMOTIONLESS Realtime DataPro (ERDP) has been advised of the possibility of such damages.

Confidentiality of login information: You agree that you will treat the information that you use to access ERDP’s Software and Information as ERDP’s confidential information.

If you are accepting this Agreement on behalf of a company, entity, or your employer, you represent that you are authorized to bind such company, entity or employer to this Agreement. You further represent that you are competent to enter into contracts.

This Agreement is effective until terminated. ERDP may terminate this Agreement at any time, and ERDP may require you to agree to modified terms to access Software and Information in the future. This Agreement will terminate immediately without notice from ERDP if you fail to comply with any provision of this Agreement. Upon termination, you must destroy all copies of Software and Information.

This Agreement does not create any partnership, franchise, joint venture, agency, or fiduciary relationship, and neither party may act in a manner that expresses or implies such a relationship.

No claim made for the Accuracy of content, Data or Service. Speed of data feed is dependent on many conditions including Broadband speed, System Performance and Network conditions. Products contained may include data available freely on net. RT/Real Time Data is only product name. Data provided for educational purposes only and not for actual trading.

Any Legal Issues will be restricted to the India Jurisdiction. This agreement is governed by the Indian laws.
